2. Description of Service
FeedbackGate provides customer feedback collection and reputation management software as a service (SaaS).
3. Account Responsibilities
You are responsible for:
- Maintaining account security
- All activity under your account
- Compliance with applicable laws
- Obtaining proper consent for SMS/email communications
4. Acceptable Use
You may not use FeedbackGate to:
- Send spam or unsolicited messages
- Violate TCPA, CAN-SPAM, or GDPR regulations
- Engage in fraudulent activities
- Abuse or overload our systems
5. SMS Compliance
You must obtain prior express written consent before sending SMS messages. You are solely responsible for TCPA compliance.
6. Payment Terms
Subscription fees are billed monthly or annually. Overdue accounts may be suspended. Refunds are provided according to our refund policy.
7. Data Ownership
You own your customer data. We own the platform. You grant us license to process your data to provide the service.
8. Service Availability
We strive for 99.9% uptime but don't guarantee uninterrupted service. We're not liable for service interruptions.
9. Termination
Either party may terminate with 30 days notice. We may suspend accounts that violate these terms.
10. Limitation of Liability
Our liability is limited to the fees you paid in the last 12 months. We're not liable for indirect or consequential damages.
11. Changes to Terms
We may update these terms. We'll notify you of material changes via email.
